Terms & Conditions

Please read the following terms and conditions carefully.

By participating in the cycle training scheme(s) detailed below you are entering into a legal agreement with Transport for Greater Manchester and agree to be bound by these terms and conditions.

Please note that where a fee is payable, under the Consumer Contracts Regulations 2013, you have the right to cancel your attendance at a course within 14 days (the “cancellation period”) from the date on which you booked the course. However, your right to cancel and obtain a refund will be lost in the event you book to attend a course on a date which is during the cancellation period.

All cycle training is administered and delivered by Transport for Greater Manchester ("TfGM"). The training is run in accordance with national guidelines set by the Department for Transport and follows the National Standard for Cycle Training.

Booking process for cycle training:

· Learn to Ride, Confidence Builder, Introduction to Quiet Roads, and Cycle Maintenance – upon registration you will choose a suitable course, date and session time as part of the booking process.

· One to One and Family cycle training – upon registration we will put you in touch with an instructor so that you may arrange a convenient session date and time.

If you are unable to attend a session, please adopt the following approach:

· Cycle Maintenance – please contact us immediately, and in any event within 14 days prior to commencement of the course in order to arrange an alternative date to attend the course.

· Learn to Ride, Confidence Builder, Introduction to Quiet Roads – please contact us immediately so that your place can be allocated to others.

· One to One and Family cycle training – please contact your instructor immediately and re arrange.

Please note:

· Acceptance on and the right to participate in cycle training is entirely at the discretion of TfGM and the instructor(s)/provider(s) who is conducting the training.

· This discretion shall be exercised in accordance with all applicable laws.

· One to One, Learn to Ride, Confidence Builder, Introduction to Quiet Roads, and Cycle Maintenance courses are open to people aged 12 years or over who live or work within Greater Manchester, with those aged from 12 to 16 needing to be accompanied by a responsible adult for the duration of the course.

· Family cycle training provides training for participating adults on how to lead their family group safely, accompanying children are the responsibility of the attending adult.

· Where a session is undersubscribed, TfGM reserves the right, at its sole discretion, to rearrange the session to an alternative date.

Cycle maintenance courses only

TfGM use approved providers to deliver their cycle maintenance courses where specific terms & conditions associated to such providers and their locations will apply. Specific detail will be shared via a pre-course briefing for your safety and course enjoyment, whilst adhering to the terms applicable to all below.

The cost of attending a cycle maintenance course is as follows:

· £10 for the basic 2-hour cycle maintenance course;

· £15 for the on the move 3-hours cycle maintenance course; or

· £30 for the intermediate 6-hour cycle maintenance course.

Amounts are inclusive of VAT and payment is due upon booking. We accept payment by way of credit or debit card only.

Please note that whilst we appreciate there may be changes in your circumstances, TfGM is not responsible and TfGM cannot be held liable for changes in your circumstances.

Where you are unable to attend the cycle maintenance course you have booked, you should contact us immediately, and in any event within 14 days prior to commencement of the course, where a transfer to an alternative course will be administered on your behalf.

Please note that you cannot request a refund once the course has been provided. Furthermore, your right to cancel and obtain a refund will be lost in the event you book to attend a course on a date which is during the cancellation period.

Where you are entitled to a refund, the same will be made within 14 days.

Bikes and helmets for One to One and Family cycle training

For the cycle training you/your party will be required: to provide your own roadworthy bicycle.

You are encouraged (but not obliged) to wear a cycling safety helmet. It is the rider’s/responsible adult’s responsibility to ensure that their safety helmet conforms to the current regulations, fits correctly and fastens securely however, your instructor/provider can advise on this.

It is the cyclist’s/attending adult’s responsibility to ensure that any bike suggested for use for training purposes is in a roadworthy condition and properly serviced.

The instructor(s)/provider(s) may, at his or her/their discretion, refuse participation on or to continue to train you if they consider a bike to be in an un-roadworthy condition.

Bikes and helmets for Learn to Ride, Confidence Builder, Introduction to Quiet Roads cycle training

Although TfGM are able to provide bicycles for use on these schemes, bringing your own, roadworthy bicycle is encouraged.

If the participant uses their own bicycle it is their responsibility to ensure that it is in a roadworthy condition. It is recommended that you ensure that your bike has been regularly and properly serviced and that if you have any concerns that you take your bike to be checked by a qualified bike mechanic prior to participation.

When participating in the training you are encouraged (but not obliged) to wear a cycling safety helmet which conforms to current regulations, fits correctly and fastens securely. If you have a safety helmet of your own that conforming to current safety standards, then you are encouraged to bring this to use.

Instructors will be able to provide safety helmets to any participant who does not have their own helmet and advise on their correct fitting.

Although instructors/providers will be on hand to assist with the fitting of safety helmets, where a rider provides their own helmet for use, it is the rider’s responsibility to ensure that their helmet conforms to the current regulations, fits correctly and fastens securely.

Please note; the instructor(s)/provider(s) may, at his or her/their discretion, refuse participation on or to continue to train you if they consider a bike to be in an un-roadworthy condition.

Cycle maintenance courses only

Where you are unable to attend the cycle maintenance course you have booked, you should contact us immediately, and in any event within 14 days prior to commencement of the course, where a transfer to an alternative course will be administered on your behalf or in certain circumstances, a full or partial refund may be given.

If you do not wish to transfer to an alternative course you may be able to get a full or partial refund if you let us know not less than 14 days from the date you booked to attend the course (“the cancellation period”) but this may be subject to deductions. Please contact us immediately if you wish to request a refund.

However, please note that you cannot request a refund once the course has been provided, even if the cancellation period is still running, or where you have failed to provide us with less than 14 days’ notice prior to commencement of the course.

Where you are entitled to a refund, the same will be made within 14 days.

Terms applicable to all who participate in cycle training courses

Participants shall wear suitable clothing for the activity and weather conditions during the training.

Participants shall conduct themselves in a manner appropriate to the activities undertaken on the training. Whilst participating on the training you agree to obey the rules of the highway and the Highway Code (where applicable), you agree to treat other participants, the instructor(s)/provider(s) and any other persons associated with the training with good manners and respect.

Participants must not be under the influence of illegal drugs or alcohol whilst participating on the scheme. The instructor(s)/provider(s) may at any time and at his/her/their discretion refuse participation on the training or to continue to train you if they consider that you are under the influence of illegal drugs or alcohol. Smoking, including e-cigarettes and vapes, is not permitted whilst participating on the training.

Cycling is a physical activity. It is your responsibility to ensure that you are physically and mentally fit enough to participate. You must ensure that the instructor(s)/provider(s) is/are aware of any medical condition which may adversely affect your training experience. Efforts will be made to accommodate any special requirements notified to us prior to commencement of any course.

The instructor(s)/provider(s) may at any time and at his or her/their discretion refuse participation on the training or to continue to train you if they consider your behaviour, attitude or ability level unacceptable or unsuitable.

Learning to cycle is fun but does carry some risks. Whilst every effort will be made to prevent accidents whilst participating in cycle training, you should accept the risks and any inherent dangers associated to learning to cycle and release TfGM from any liabilities in connection therewith.

Participation in the training is at your own risk. TfGM or its delivery instructors/providers do not accept responsibility for loss or damage, to your property or that of a third party however caused.

It is recommended that you consider purchasing appropriate insurance to insure you against liability in respect of injury to a third parties or damage to property of a third parties which may arise as a result of your participation on the scheme.

TfGM reserves the right to cancel or reschedule course dates. If TfGM is required to cancel your session or you cannot attend a rescheduled date, TfGM will endeavour to book you on an alternative session.

Terms & Conditions - Data Protection

Transport for Greater Manchester (TfGM) is the Data Controller of any personal data collected in relation to these cycle training courses. The information you provide will be used to administer your course, contact you afterwards to ask about your experience, and for monitoring and evaluation purposes.

TfGM process your personal data because it is necessary for the performance of the contract with you (to deliver the training course). We process your demographic data because it is necessary for a task carried out in the public interest, exercising our Powers under s.10A of the Transport Act 1968. Some of the data we collect is considered special category data, which we process for reasons of substantial public interest: equality of opportunity and treatment.

We will only share your personal data with the trainers who deliver the training.

We will delete the personal data you provide when booking a course 2 years after completion of the course. If you create an account with us, we will delete your personal data 2 years after the last activity on your account.
