Background

UNDP supports the municipalities in Kosovo to develop adequate policies and regulations in different aspects of local governance. UNDP and the Municipality of Prishtina will work together in regulating aspects of the management of subsidy schemes, use of public space for the placement of works of art, planning architectural design activities, and private property ownership regulations with a focus on the conservation of the environment. The Directorate of Culture is responsible for and carries out planned cultural activities, guided by the local and cultural resources of the Municipality of Prishtina. The Directorate of Public Services, Defense and Rescue of the Municipality of Prishtina defines and supervises the provision of local public services, including the organization of the maintenance of public spaces, green spaces, public parks and cemeteries. The local consultant will provide advisory services to both Directorates in the carrying out of necessary activities in the above-mentioned areas, as well as contribute to the development of clear criteria for the evaluation of cultural projects that are financed by the Municipality of Prishtina, so that the evaluation is done fairly and in the interest of the cultural development of the city.

Objectives of Assignment
With subject matter support from the respective Directorate, the objective of the assignment is to provide legal advisory services to the Directorate of Culture and the Directorate of Public Services, Defense and Rescue of the Municipality of Prishtina.

Duties and Responsibilities

Under the direct supervision of the UNDP Assistant Resident Representative and day-to-day supervision by the Mayor’s cabinet, and working closely with the Directorate of Culture and the Directorate of Public Services, Defense and Rescue of the Municipality of Prishtina, the local consultant will undertake the following duties and responsibilities:

With the support of the Directorate of Culture provide advisory services to the same Directorate:

  • Drafting of the Regulation on Subsidies of the Directorate of Culture and accompanying instruments for its implementation;
  • Drafting of the Regulation on procedures and criteria for placing works of art in public spaces;
  • Drafting of the Application Procedures with the aim of simplifying them in order for the cultural community to have easier access to financial assistance from local authorities;
  • Drafting of the Manual for designing architectural design contests and accompanying mechanisms up to their evaluation;
  • Drafting specific competitions which are part of the work plan of the Directorate of Culture.

With the support of the Directorate of Public Services, Defense and Rescue provide advisory services to the same Directorate:

  • Drafting of Regulations on the obligations of Owners and Part-owners of Private Properties of Pristina, where the rights and obligations of private landowners are defined;
  • Drafting of the Regulations on the rights and obligations of businesses in relation to the conservation of the environment;
  • Harmonization of the Regulations of the Directorate of Public Services, Defense and Rescue with the competencies of the Directorate of Inspection to set appropriate fines for irresponsible owners in the maintenance of private property by developing preventive instruments for environmental degradation and reduction of the amount of waste in the private property.

Remuneration - Lump Sum Amount
The Contract is based on a lump-sum remuneration, four weeks, subject to submitting the expected deliverables, cleared by the mayor’s Chief of Cabinet and certified by the direct supervisor in UNDP. The payment is to be released upon acceptance of the deliverables by the Directorate of Culture and the Directorate of Public Services, Defense and Rescue and UNDP.

Recommended Presentation of Offer

  • Updated P11/CV, indicating all past experience from similar projects, as well as the contact details (email and telephone number) of the Candidate and at least three (3) professional references
  • Brief description of why the individual considers him/herself as the most suitable for the assignment, and a methodology on how they will approach and complete the assignment.
  • Financial proposal - that indicates the all-inclusive fixed total contract price, supported by a breakdown of costs.

Criteria for selection of the Best Offer
Offers will be evaluated utilizing a combined Scoring method – where the qualifications and methodology will be weighted a max. of 40%, the interview which will be weighted a max. of 30% and combined with the financial proposal which will be weighted 30%.

Required Skills and Experience

Education

  • Advanced university degree (Master’s degree or equivalent) in Administrative or Civil Law. An advanced university degree in Law and Management of Infrastructure or related field is considered an asset. A first-level university degree in similar fields in combination with two additional years of qualifying experience may be accepted in lieu of the advanced university degree.

Experience

  • Minimum 3 years of relevant work experience in the drafting of Regulations of public institutions.
  • Solid knowledge of legislative drafting processes.
  • Knowledge and experience in the legal aspects of urban planning or infrastructure is considered an asset.
  • Familiarity with administrative processes in public institutions is desirable.

Language requirements

  • Fluency in English and Albanian is required. Knowledge of Serbian is an asset.
